Allergy Force LLC ("us", "we", or "our") operates the http://www.allergyforce.com website and the Allergy Force mobile application (hereinafter referred to as the "Service").

 

This page informs you of our policies regarding the collection, use and disclosure of personal data when you use our Service and the choices you have associated with that data.

 

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

 

1.     Definitions

Application (or App)

Application (or App) is the Allergy Force mobile application operated by Allergy Force LLC.

Personal Data

Personal Data means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).

Account

When you download the Application for the purpose of accessing the Service, you provide Personal Data. Account means the entirety of Personal Data you provide to enable your use of the Service. The Personal Data underlying your Account may include, but is not limited to, your email address, first and last name, phone number, address including the street, city, state, province, country and zip/postal code, and allergy profile.

 

User Name

Your User Name is the name you provide when you set up your Account that will be linked to and included with your Allergy Profile. This name is how you will appear to other Allergy Force community members if you choose to make your allergy profile visible to other community members.

 

Allergy Profile

Your Allergy Profile is the list of food allergies you select that enable your use of the Application.Your Allergy Profile includes the User Name you provide when you set up your Account.You may opt to make your Allergy Profile private or public and can modify this selection at any time at your discretion.

 

Usage Data

Usage Data is data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Cookies

Cookies are small files stored on your device (computer or mobile device).

 

Data Controller

Data Controller means the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal information are, or are to be, processed. For the purpose of this Privacy Policy, we are a Data Controller of your Personal Data.

 

Data Processor (or Service Provider)

Data Processor (or Service Provider) means any natural or legal person who processes the data on behalf of the Data Controller. We may use the services of various Service Providers in order to process your data more effectively.

 

Data Subject (or User)

Data Subject is any living individual who is using our Service and is the subject of Personal Data.

We collect several different types of information for various purposes to provide and improve our Service to you.

 

TYPES OF DATA COLLECTED

 

Personal Data

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you ("Personal Data"). Personal Data may include, but is not limited to:

  • Allergy Profile

  • Cookies and Usage Data

 

You can always refuse to supply personally identifiable information, except that it may prevent you from engaging in Service-related activities or in downloading the App. For Allergy Profile-related data you may opt to make your Allergy Profile private or public and can modify this selection at any time at your discretion.

 

The Standards for Privacy of Individually Identifiable Health Information (“Privacy Rule”) is a set of national standards for the protection of certain health information. The U.S. Department of Health and Human Services (“HHS”) issued the Privacy Rule to implement the requirement of the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”.) The Privacy Rule applies to “Covered Entities” under HIPAA which are Health Plans, Health Care Providers and Health Care Clearinghouses (e.g., billing services, community health management information systems, value-added networks and switches performing clearinghouse functions.)  The Privacy Rule does not apply to Allergy Force LLC because it is not a "Covered Entity" under HIPAA. 

 

We electronically collect and store information about your allergies.  When you submit your allergy information, information related to the testing and evaluation of your allergies, or any other private health-related information to us, including your medical providers’ allergic reaction protocols, it is no longer covered under HIPAA.

 

While we will take reasonable precautions to ensure the privacy of the personal information you electronically submit to us, you agree that the personal information you submit to us is no longer confidential and might be seen by third parties with or without your consent.  We use commercially reasonable data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information.  While we make efforts to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third parties from illegally obtaining this information.

 

By accessing the Service using your Instagram, Twitter or Facebook credentials, or any other third-party services, you permit us to access certain information from your profile on Instagram, Twitter, Facebook or any other such third-party services for use by the Service. You may be able to control the amount of information that is accessible to us by adjusting your account privacy settings on Instagram, Twitter, Facebook or any other such third-party services. By using the Service, you are authorizing us to collect, store, retain, and use indefinitely, in accordance with our Privacy Policy, any and all information that you permitted Instagram, Twitter, Facebook or any other such third-party services to provide to us.

 

Usage Data

We may also collect information that your browser sends whenever you visit our Service or when you access the Service by or through your computer ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g., IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, your click patterns, unique device identifiers and other diagnostic data. We use this data to provide features of our Service and to improve and customize our Service.

 

When you access the Service with a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data. We use this data to provide features of our Service and to improve and customize our Service.

 

Location Data

We may use and store information about your location ("Location Data") if you give us permission to do so.  We use this data to provide features of our Service, to improve and customize our Service.

 

You can enable or disable Location Data when you use our Service at any time by way of your device settings.

We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information.

Allergy Force LLC uses the collected data for various purposes:

  3.  To allow you to participate in interactive features of our Service when you choose to do so

  5.  To monitor the usage of our Service

Social Media Profile Data

By using the Service, you are authorizing us to collect, store, retain, and use indefinitely, in accordance with this Privacy Policy, any and all information that you permitted Instagram, Twitter, Facebook or any other such third-party services to provide to us. 

 

 

4.     Legal Basis for Processing Personal Data Under the General Data Protection Regulation (GDPR)

 

If you are from the European Economic Area (EEA), Allergy Force LLC’s legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.

 

Allergy Force LLC may process your Personal Data because:

  2.  You have given us permission to do so

  3.  The processing is in our legitimate interests and it is not overridden by your rights

Allergy Force LLC will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.

 

Allergy Force LLC will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or improve the functionality of our Service, or we are legally obligated to retain this data for longer periods.

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

 

If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there. Allergy Force LLC will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy, and that no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place, including the security of your data and other personal information.

 

7.     Disclosure of Data

 

We do not sell, trade, or otherwise transfer your personally identifiable information to outside parties. This excludes trusted third parties who assist us in operating our Service, or administrating activities on our behalf, including but not limited to analytics, advertising and promotions.

Business Transaction

If Allergy Force LLC is involved in a merger, acquisition or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.

Disclosure for Law Enforcement

Under certain circumstances, Allergy Force LLC may be required to disclose your Personal Data if required to do so by law, or in response to valid requests by public authorities (e.g., a court or a government agency).

8.     Security of Data

 

The security of your data is important to us.  We use commercially reasonable data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information.  While we make efforts to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third parties from illegally obtaining this information. No method of transmission over the Internet or method of electronic storage is 100% secure, therefore, we cannot guarantee its absolute security.

 

9.     Our Policy on "Do Not Track" Signals Under the California Online Privacy Protection Act (CalOPPA)

 

We do not support Do Not Track ("DNT"). DNT is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable DNT by visiting the Preferences or Settings page of your web browser.

  4. The right of restriction. You have the right to request that we restrict the processing of your personal information.

  6. The right to withdraw consent. You also have the right to withdraw your consent at any time where Allergy Force LLC relied on your consent to process your personal information.

Our Service is directed at a general audience and intended to be used by adults. No part of our Service is structured to attract anyone under the age of 13.
